Wills, Trusts & Probate

What Mark E. Ross will provide for you…

When planning for the future of your loved ones you should always give strong consideration to an estate plan. A comprehensive plan includes services and tools that I provide that will provide assistance for your family in their immediate future and beyond.

WILLS: Most people need a Will; it’s a basic estate planning document. Preparing a Will lets you:
  • Choose someone to be in charge of your estate after your death
  • Have a say over who gets your property when you pass away
  • Name a guardian for your minor children
  • Give guidance for how debts and taxes are to be paid
  • Balance the needs of a blended family
  • And more
LIVING TRUSTS: You can choose a trustee today, yourself; so you know that specific assets and care will be given to your loved ones, minors, heirs with special needs.

POWER OF ATTORNEY: Assign someone you trust, to act on your behalf making financial and medical decisions in the event of your incapacity.

FAMILY LIMITED PARTNERSHIPS: Helps you to transfer wealth from one generation to the next.

PROBATE and TRUST ADMINISTRATION: Make sure everything comes together as the loved one intended when they prepared their Will or Trust.

Why Not a Do-it-Yourself Will?

Preparing a Will that works as intended requires some specialized knowledge. Without understanding the rules that apply to property, it’s easy to prepare a do-it-yourself Will that just doesn’t work as you’d planned. You should also consider:
  • There are certain signing rules, and if you don’t follow them, your Will won’t be valid
  • Leaving out language or using the wrong language can spell disaster for your loved ones
  • Online do-it-yourself Will companies don’t provide legal advice . . . or guarantees and some have been sanctioned by the Indiana Supreme Court for illegally practicing law.

Eliminating Uncertainties Using Estate Planning

A properly-created estate plan helps to eliminate uncertainties over the administration of your estate and maximize the value of your estate by reducing taxes and other expenses. An estate plan, which includes legal planning tools such as a Will, Living Trust, and Powers of Attorneys will ensure that people you trust will act on your behalf to disburse your assets per your wishes. An estate plan can also specify unique arrangements for the care of dependents, loved ones, those with disabilities, and even specify wishes for charitable contributions. Every single decision made involving your estate planning is important. If you are looking for experienced and effective legal representation in estate planning please call me to set up a time to meet today.
